• We attempt to obtain accurate descriptions of the Item(s) for sale. However, we are not responsible for typographical errors, mistakes or omissions relating to pricing, text, descriptions or photography or in any manufacturers specifications provided. Please verify all specifications on this item prior to bidding.
• Please do not make any assumptions about the nature, identity, features, quality or condition of Item(s) or what is included with an Item, including assumptions based on any photographs appearing in the listing. You must carefully read the listing description. Unless something is specifically identified as new, you should assume it is used. If you are unclear about something on or about the listing, please ask.

Payment / Shipping:

• Payment must be made within 5 days following the close of the auction. If payment is not received in a timely manner, we may, in addition to any other remedies we may have, cancel the sale and put the Item(s) back up for bid.
• Sales tax of 6.75% will be collected for all items shipped to locations inside the state of Illinois.
• Please note that Boxaroo is not the owner of the items we sell (the "Item(s)"). We act as an auction broker and assist in facilitating delivery of the Item(s), but we do not take possession of the Item(s) at any point.
• We endeavor to have most orders ship within seven (7) days of our receipt of verifiable payment. However, shipping Item(s) the right way often takes time, so we ask that you be patient. Orders are shipped directly by the owners, and shipping delays are possible. We are not responsible for delays in shipping that are beyond our control. We are not responsible for any delays, damage, or losses that may occur during shipment. Shipping insurance is offered at the time of purchase to protect the buyer, but if insurance is not purchased any loss is the buyer's sole responsibility.
• We DO NOT ship internationally, or to APO/FPO. U.S. bidders only.

Return/Refund Policy:

• If the Item(s) purchased is not delivered (and no delivery has been attempted) within 14 days of our receipt from you of verifiable payment in full, then you may cancel your order upon written notice and receive a complete refund of your payment to us, provided that delivery is not made or attempted within two (2) business days following our receipt of such notice.
• If the Item(s) purchased are not substantially as described in the auction listing (including condition) and you so notify us in writing within 5 days following delivery of the Item(s) to the address designated by buyer for delivery, then upon prompt return of the item to us and our verification that the item is not substantially as described, we will, at our option, repair or replace the Item with another Item so that the Item does comply with the description or refund the purchase price you paid (the latter option in most cases). All returns must include all original components and packaging materials in order to obtain a refund. Customers are responsible for return shipping with proper packaging.
• If buyer does not notify us in writing within 5 days following delivery of an Item that such Item is not substantially as described, or if buyer notifies us or confirms to us that the Item is acceptable, then the item will be deemed accepted, and no refunds will be made after that time.
• Certain Item(s) may come with a manufacturer's warranty. If there are any warranty issues, they are handled solely by the manufacturer. You should not assume that a manufacturer's warranty is applicable unless the Item description so states. It is up to the buyer to determine the applicability of any warranty.
• THE RETURN/REFUND POLICY SET FORTH ABOVE IS BUYERS SOLE AND EXCLUSIVE REMEDY, AND OUR SOLE AND EXCLUSIVE LIABILITY, OF ANY KIND WITH RESPECT TO ANY ITEM(S) PURCHASED THROUGH THIS AUCTION.

Warranty Disclaimer; Limitation of Liability

• EXCEPT FOR THE RETURN/REFUND POLICY STATED ABOVE, ALL ITEM(S) ARE SOLD "AS IS," AND WE SHALL HAVE NO LIABILITY OF ANY KIND (WHETHER ARISING IN CONTRACT, WARRANTY, TORT, NEGLIGENCE OR OTHERWISE) ARISING OUT OF OR IN CONNECTION WITH ANY ITEM(S) YOU PURCHASE THROUGH THIS AUCTION OF FOR ANY DAMAGES YOU SUSTAIN FROM SUCH ITEM(S) OR FROM YOUR PARTICIPATION IN THIS AUCTION, INCLUDING ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OR LOSS OF DATA OR PROFITS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
• IN NO EVENT SHALL OUR LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, ARISING OUT OF OR RELATING TO THE ITEM(S) OR THE AUCTION EXCEED THE AMOUNT YOU ACTUALLY PAY TO US FOR THE ITEM(S) INCLUDED IN SUCH AUCTION. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON INFRINGEMENT, AS TO THE ITEM(S). IN NO EVENT SHALL ANY CLAIM, ACTION OR PROCEEDING BY YOU RELATED IN ANY WAY TO ANY PRODUCTS OR SERVICES BE INSTITUTED MORE THAN THREE (3) YEARS AFTER THE CAUSE OF ACTION AROSE.

Arbitration

• In the event that any disputes arise as to whether an Item is as described in the auction and whether you are entitled to a refund under the return/refund policy set forth herein, YOU AGREE THAT THE SOLE AND EXCLUSIVE FORUM AND REMEDY FOR ANY AND ALL SUCH DISPUTES SHALL BE FINAL AND BINDING ARBITRATION.
• Arbitration under this Agreement shall be conducted by the American Arbitration Association (the "AAA") under its Commercial Arbitration Rules and, in the case of consumer disputes, the AAA's Supplementary Procedures for Consumer Related Disputes ( the "AAA Consumer Rules") (collectively the "AAA Rules"). The location of the arbitration and the allocation of costs and fees for such arbitration shall be determined in accordance with such AAA Rules and shall be subject to the limitations provided for in the AAA Consumer Rules (for consumer disputes). The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction.

General

• WE RESERVE THE RIGHT TO CANCEL AN AUCTION AT ANY TIME FOR ANY REASON IN OUR SOLE DISCRETION.
• If any provision of these Terms and Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.
• These Terms and Conditions your purchase of the Item(s) shall be governed by and construed in accordance with the laws of the State of [Illinois] applicable to agreements made and to be entirely performed within the State of [Illinois], without resort to its conflict of law provisions. You agree that any action at law or in equity arising out of or relating to these Site Terms shall be filed only in the state and federal courts located in [McLean] County, [Illinois] and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action or proceeding arising out of these Site Terms.
